Suidani challenge speaker’s ruling

OUSTED Premier of Malaita Province, Daniel Suidani is challenging the speaker’s ruling that leads to his defeat.

Statement from Suidani’s political camp says the fight is not over.

Suidani’s advisor Celsus Irokwata Talifilu in a statement says Suidani (the then Premier) seeks the High Court for a Judicial Review quoting breach of legal processes as a matter of consideration.  

He alleges that the Speaker of Malaita Province has acted outside of his powers and that the declaration to continue with the motion was ultra vires.

Talifilu adds that the speaker’s action not only breaches the pending court ruling but also invades relevant Standing Orders such as Standing Order 103 part 14, 15 and 16.

The motion was passed without the presence of the premier (then) and his executive as they are waiting on the High Court to deliberate on the case that was filed by Suidani challenging the speaker’s decision to continue with the motion.

Prior to the motion, Suidani and his executive submits a case to the High Court seeking “interim order” to wait for the judicial review before any proceeding.

However, the High Court refuses to grant the interim order the day when the motion was tabled and the motion continues.

Though they lost the fight, Suidani’s team believes the court will deal with the substantive case presented for the judicial review and they will hit back.

Meanwhile Deputy Premier Hon Glen Waneta will make a new fresh case against the Speaker with new evidence.

The fresh claim seeks the court for an interim order to cease the administration of the “motion of no confident” results.

According to Waneta, the process resulting in the tabling of the motion of no confidence was an abuse of the process and therefore illegal.

MARA believes that the best way forward to counter corruptive practices and the abuse of processes is to take these matters to the court.

In the meantime, Suidani and his MARA members acknowledge the public of Auki and Malaita at large for their good behavior shown during these extraordinary times in the political history of Malaita province.
